Use of the site

Eligibility

By accessing or using 55gamewin.in.net (the "Site"), you confirm that you are at least 18 years of age, legally capable of entering into binding agreements under applicable Indian law, and that your use of the Site complies with all laws and regulations in your jurisdiction. If you do not meet these requirements, you must immediately cease using the Site.

Permitted use

You may access and use the Site solely for lawful, personal, and non-commercial purposes. You agree not to reproduce or distribute Site content without prior written consent, use automated bots or scrapers to extract data, attempt unauthorised access to the Site or its servers, transmit malicious code or harmful data, or engage in fraudulent, deceptive, or unlawful conduct of any kind while using the Site.

Account responsibilities

If you create an account on the Site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify 55 Game immediately if you suspect unauthorised use. Where payments are involved, for example via PhonePe, Google Pay (GPay), or BHIM UPI, you remain solely responsible for authorising transactions from your registered payment instrument. 55 Game will not be liable for any loss arising from your failure to safeguard your account or payment credentials.

Modifications to the Site

55 Game reserves the right to modify, suspend, or discontinue any part of the Site at any time without prior notice and may update these Terms periodically. Continued use of the Site after any changes constitutes your acceptance of the revised terms. It is your responsibility to review these terms regularly.

Intellectual property

Ownership of content

All content on the Site, including text, graphics, logos, icons, images, audio clips, game assets, and software, is the exclusive property of 55 Game or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable international intellectual property conventions. No content may be used without express written authorisation from 55 Game.

Restricted use of content

You receive only a limited, non-exclusive, non-transferable, revocable licence to access the Site for personal, non-commercial purposes. You must not copy, republish, or distribute any Content; remove or alter any proprietary notices; use the 55 Game name or trademarks to imply endorsement; or reverse-engineer any software forming part of the Site.

User-submitted content

If you submit reviews, comments, or feedback to the Site, you grant 55 Game a worldwide, royalty-free, perpetual, and irrevocable licence to use, reproduce, modify, and distribute such content in connection with the operation of the Site. You warrant that your submissions do not infringe any third-party intellectual property rights or any other rights.

Limitation of liability

No warranties

The Site and all Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. 55 Game does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Site is entirely at your own risk.

Exclusion of damages

To the fullest extent permitted by applicable Indian law, 55 Game, its directors, employees, affiliates, and licensors shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of, or inability to use, the Site. This includes, without limitation, loss of data, loss of profits, failed transactions processed through PhonePe, GPay, BHIM UPI or any other payment method, or any other financial loss of any nature.

Cap on liability

Where liability cannot be entirely excluded under applicable law, the total aggregate liability of 55 Game to you for any claim arising from your use of the Site shall not exceed the amount, if any, paid by you to 55 Game in the three months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes liability for fraud, wilful misconduct, or any other liability that cannot lawfully be limited or excluded.

Governing law

Applicable law

These Terms of Service and any dispute or claim arising out of or in connection with them, including non-contractual disputes or claims, shall be governed by and construed exclusively in accordance with the laws of India, including but not limited to the Information Technology Act, 2000, the Consumer Protection Act, 2019, and such other statutes as may be applicable to online services and digital gaming platforms operating within India.

Jurisdiction

You irrevocably agree that the courts located in India shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or your use of the Site. By continuing to use the Site, you submit to the personal jurisdiction of those courts and waive any objection to proceedings in such courts on the grounds of venue or inconvenient forum.
